Labour law

Labour law governs the rights and duties of workers and employers and the forms of employee integration. It is a set of different legal norms, which are covered by laws, administrative decisions, collective agreements, international acts and even judicates.

The rights of workers are defined in ZDR-1 (Employment Relationship Act), in other laws (eg Minimum Wage Act, Health and Safety at Work Act) and collective agreements. Special features for public employees are regulated by the Public Employees Act, the Public Sector Salary System Act, the Workers’ Ordinance Act and other laws.

Workers and employers often find themselves disputing about the conclusion or cancellation of a contract of employment, payment for work, reimbursement of expenses, payment of social security contributions, overtime work, annual leave allowance, severance pay and other violations of labour law.

We advise employers and prepare all the acts necessary for regulating employment relationships (collective agreements, general acts, employment contracts, other types of contracts related to labour law). We explain our clients the meaning of particular terms of the employment contract and give our opinion about them. We advise our clients on the content of the non-competition clause and the effective protection of employers’ interests. We also advise in the process of cancellation of the employment contract and, if necessary, we form our client the cancellation of the employment contract.

In resolving conflicts between workers and employers, we strive for a consensual and extra-judicial solution to the conflict, as we are aware of the importance of good relations between employees and management.

If an amicable settlement of disputes is not possible we represent workers or employers in the labour court. We represent our clients in labour court in case of regular or extraordinary cancellation of the employment contract and all other cases in relation to the employment relationship.
